3. LINKS4JOBS INTELLECTUAL PROPERTY RIGHTS

All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, source code, algorithms, user interface design, and the compilation thereof (collectively, 'Platform Content'), are owned by Links4Jobs, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The Links4Jobs name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Links4Jobs or our affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.

All rights in the Platform Content are expressly reserved. Any unauthorized use, reproduction, distribution, modification, public display, public performance, or creation of derivative works is strictly prohibited and may result in severe civil and criminal penalties.
3.3 Limited License to Users
Subject to your compliance with our Terms of Service and this Copyright Policy, Links4Jobs grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Access and use the Platform for your personal, non-commercial use (job seekers) or internal business purposes (employers and recruiters)
- View, download, and print content from the Platform solely for your authorized use
- Use any software or applications we provide as part of the Platform in accordance with their license terms
This license does not include any right to:
- Modify, copy (except as expressly permitted), distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Platform Content
- Use any data mining, robots, scraping, or similar data gathering or extraction methods
- Download (other than page caching) or modify any portion of the Platform or any content on it
- Use the Platform or its content for any commercial purpose not expressly permitted by us
- Reverse engineer, decompile, or disassemble any software or technology used on the Platform
Any use of the Platform not expressly permitted by this Copyright Policy or our Terms of Service is a breach of these terms and may violate copyright, trademark, and other laws.
4. USER-GENERATED CONTENT
4.1 Your Content and Retention of Rights
When you upload, submit, post, or transmit any content to the Platform, including resumes, CVs, cover letters, job postings, company descriptions, profiles, messages, comments, reviews, photos, videos, or any other materials (collectively, 'User Content'), you retain all ownership rights you have in that User Content.
However, by submitting User Content to the Platform, you represent and warrant that:
- You own the User Content or have obtained all necessary rights, licenses, consents, and permissions to use and authorize us to use the User Content as described in this policy
- Your User Content does not and will not infringe, violate, or misappropriate any third party's copyright, trademark, patent, trade secret, moral rights, rights of publicity or privacy, or other intellectual property or proprietary rights
- Your User Content does not contain any viruses, malware, or other harmful code
- Your User Content complies with all applicable laws, regulations, and our Terms of Service
4.2 License Grant to Links4Jobs
By submitting User Content to the Platform, you grant Links4Jobs a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable, perpetual, irrevocable license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform, and otherwise exploit your User Content in connection with operating and providing the Platform and our business, including without limitation for:
- Displaying your profile, resumes, and job applications to potential employers and recruiters
- Distributing job postings and employer content to job seekers
- Marketing, promoting, and demonstrating the Platform and our services
- Improving our matching algorithms and recommendation systems
- Creating aggregated, anonymized data and analytics
- Storing, backing up, and archiving User Content
- Any other purpose disclosed in our Privacy Policy or Terms of Service
This license includes the right to sublicense these rights to third parties, including our service providers, business partners, and affiliates, who require access to User Content to provide services on our behalf.
4.3 Public vs. Private Content
Public Content: Depending on your privacy settings, some User Content may be publicly visible to other Platform users, search engines, and the general public. This may include:
- Public profile information and professional summaries
- Job postings and company descriptions
- Reviews, ratings, and comments on public forums
- Any content you specifically designate as public
Private Content: Other User Content is visible only to specific recipients you authorize, such as:
- Job applications sent to specific employers
- Private messages and communications
- Profile information marked as private in your settings

4.4 Removal of User Content
You may request removal of your User Content by:

Please note that:
- Removal may not be immediate and may take up to 30 days
- We may retain copies of User Content in backup systems for a limited period
- Content shared with employers or other users may remain in their systems
- We may be required to retain certain content for legal, regulatory, or business purposes
- The license granted in Section 4.2 continues for User Content used in derivative works, aggregated data, or other purposes that survive content deletion
4.5 Prohibited User Content
You agree not to submit User Content that:
- Infringes any copyright, trademark, patent, trade secret, or other intellectual property right
- Contains copyrighted material (text, images, music, videos) without proper authorization
- Violates any law, regulation, or third-party rights
- Is false, misleading, fraudulent, or deceptive
- Is defamatory, obscene, pornographic, vulgar, or offensive
- Promotes discrimination, bigotry, racism, hatred, harassment, or harm
- Contains viruses, malware, or other harmful code
We reserve the right to remove any User Content that violates this policy, our Terms of Service, or applicable law, with or without notice.
5. DMCA NOTICE AND TAKEDOWN PROCEDURES
5.1 Reporting Copyright Infringement
If you believe that content on our Platform infringes your copyright, you may submit a notice of alleged infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512(c). To be effective under the DMCA, your notice must be in writing and contain substantially the following information:
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works. Provide specific details including:

- Screenshots or other evidence showing the infringement
- Your contact information. Provide sufficient information for us to contact you, including:
- Full legal name
- Physical mailing address
- Telephone number
- Email address
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
Example: 'I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.'
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Example: 'I declare, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner.'
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. This can be a typed signature, scanned signature, or electronic signature.

Important: For your DMCA notice to be valid, it must include all required elements listed above. Incomplete notices may not be processed. Please do not send non-copyright-related inquiries to the Copyright Agent; such communications will not receive a response.
5.3 Our Response to DMCA Notices
Upon receipt of a valid DMCA notice, we will:
- Promptly investigate the alleged infringement
- Remove or disable access to the allegedly infringing material if the notice complies with DMCA requirements
- Notify the user who posted the allegedly infringing content that we have removed or disabled access to it
- Provide the user with a copy of the DMCA notice (including your contact information)
- Inform the user of their right to file a counter-notification
We typically respond to DMCA notices within 1-3 business days. However, this timeframe may vary depending on the complexity of the claim and volume of requests.
5.4 False Claims and Misrepresentation
WARNING: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
Before submitting a DMCA notice, please ensure that:
- You are the copyright owner or authorized to act on their behalf
- The content is actually infringing (not fair use or licensed)
- You have identified the correct content on our Platform
- All information in your notice is accurate
We reserve the right to seek damages from any party who submits a DMCA notice or counter-notification in bad faith.
6. DMCA COUNTER-NOTIFICATION PROCEDURES
6.1 Filing a Counter-Notification
If you believe that your content was removed or disabled as a result of mistake or misidentification, you may file a DMCA counter-notification. To be effective, a counter-notification must be in writing and contain substantially the following information:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location where it appeared before removal. Provide:
- Specific URL(s) or description of the removed content
- Date of removal (if known)
- Your contact information:
- Full legal name
- Physical address
- Telephone number
- Email address
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Example: 'I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.'
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if your address is outside the United States), and that you will accept service of process from the person who filed the original DMCA notice or their agent.
6.2 Where to Send Counter-Notifications
Counter-notifications must be sent to our Copyright Agent at the same address as DMCA notices:

6.3 What Happens After You File a Counter-Notification
Upon receipt of a valid counter-notification, we will:
- Promptly provide a copy of the counter-notification to the person who filed the original DMCA notice
- Inform that person that we will restore the removed content or cease disabling access to it within 10-14 business days
- Restore the content or cease disabling access to it within 10-14 business days, unless our Copyright Agent receives notice that the original complaining party has filed a court action seeking a restraining order against you
Important: By filing a counter-notification, you are consenting to the jurisdiction of a Federal court and indicating your willingness to be sued by the original complaining party. Please consult with legal counsel before filing a counter-notification if you are uncertain about your rights.
7. REPEAT INFRINGER POLICY
7.1 Policy Statement
In accordance with the DMCA and other applicable laws, Links4Jobs has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
7.2 Determination of Repeat Infringers
A user may be considered a repeat infringer if:
- The user has received two or more valid DMCA takedown notices for different instances of infringement
- The user has received one or more valid DMCA takedown notices and has a history of other intellectual property violations
- The user has been subject to final judicial determinations of copyright infringement
- The user repeatedly posts content after receiving warnings about potential infringement
We consider various factors when determining whether to terminate an account, including:
- The number and severity of infringement claims
- Whether the user has filed successful counter-notifications
- The user's overall conduct on the Platform
- Whether the infringement appears to be intentional or willful
7.3 Account Termination Process
If we determine that a user is a repeat infringer:
- We will notify the user of the determination and pending termination
- The user's account will be permanently terminated
- All User Content associated with the account may be removed
- The user will be prohibited from creating new accounts on the Platform
- We may retain certain information for legal and compliance purposes
Account termination decisions are final and are not subject to appeal, except as required by applicable law.
8. OTHER INTELLECTUAL PROPERTY RIGHTS
8.1 Trademark Policy
Links4Jobs respects the trademark rights of others. Users are prohibited from using trademarks, service marks, trade names, logos, or other identifiers in a manner that:
- Is likely to cause confusion about the source of products or services
- Implies sponsorship, endorsement, or affiliation without authorization
- Dilutes or tarnishes a famous mark
- Violates applicable trademark laws
Reporting Trademark Infringement:

- No actual knowledge of infringing activity on our Platform
- No financial benefit directly attributable to infringing activity
We expeditiously remove or disable access to allegedly infringing material upon receiving proper notice.
